Letter: Another in support of zoning repeal (May 23, 2008)

I urge the voters of Kennebunkport to vote for the repeal of contract zoning and against the revision and/or amendment for the following reasons:
1. We have appropriate land use tools such as planned unit development, special exceptions, variance provisions and site plan review already in place to control land development.
2. Contract zoning will result in a hodgepodge, spot zoning areas throughout the community.
3. A contract zoning agreement will encourage development that may be inconsistent with our Comprehensive Plan.
4. The community may bargain away its authority and in the end negotiated ad-hoc agreements will weaken zoning regulations that were intended to apply equally to all land uses within a district.
5. There is a clear potential for abuse with offers from applicants to contribute to community programs or offers to build new community facilities that have no connection to the application for rezoning.
6. The applicant can “buy” the contract zone.
7. The revision as proposed gives more power to the board of selectman in that the board can place a contract zone on the warrant even if the planning board does not recommend that the contract zone be placed on the ballot.
The opportunity to vote to repeal contract zoning is presented to the voters because 251 registered voters of Kennebunkport requested the issue be placed on the ballot.
Some may say that the petition was brought by Goose Rocks Beach voters. Nothing could be further from the truth as 42 percent of the signatories reside in other areas of our town.
